Mr. Asselta began his career working for a defense firm that exclusively dealt with criminal appeals and post-conviction criminal litigation. Mr. Asselta has prepared briefs and motions concerning major drug trafficking crimes, criminal conspiracy and financial crimes, to name a few. He is also an experienced litigator, having tried numerous matters. Mr. Asselta has represented clients in Florida, New Jersey and numerous federal courts of appeals.As part of his appellate and post-conviction litigation practice, Mr. Asselta painstakingly reviews a client’s entire case, identifying issues that could potentially result in a successful appeal or challenge through a post-conviction motion and hearing. For those convicted of a criminal charge, these challenges may lead to the dismissal of charges or the ordering of a new trial based on legal errors, prosecutorial misconduct, ineffective assistance of counsel, or claims of insufficiency of the evidence.Mr. Asselta’s education and school law practice includes representing the interests of students of any age when dealing with their public schools, private schools, colleges, universities, graduate, technical and vocational schools throughout the state. He understands the difficulties and pressures clients face when confronted with various issues such as academic issues, disciplinary issues and financial issues. For nearly ten years Mr. Asselta represented a public school district, giving him great insight into the process and procedures a school utilizes in dealing with student disciplinary issues, special education compliance, and the legal side of the education process as a whole. This opportunity has given Mr. Asselta a unique understanding of the challenges that students face and how the school approaches and handles these challenges. The same detailed approach taken to his appellate and post-conviction work is applied to his education law practice. A critical review of documents, assisting with negotiations and meticulous hearing and trial preparation are but a few of the ways Mr. Asselta ensures that his clients are provided the level of services and care that each deserve.Richard grew up in New Jersey and attended college in Washington, D.C. He attended law school in South Florida where he served as an Associate Editor of his school’s Law Review. Upon graduation Richard worked for a firm that specialized in federal appellate and post-conviction law. While there, he assisted in the preparation of appellate briefs and motions in federal courts throughout the country. He then worked on a variety of complex civil matters and represented a public school district. In addition to litigating cases, Richard was responsible for most of the firm’s motion practice and appellate litigation.
