The client was facing 5 15 years in prison on the Aggravated Assault charge and 1.5 3 years in prison on the Disorderly Conduct charge, if convicted. The result of the misdemeanor assault conviction was no prison, no jail, and no felony offense on his record. Not Guilty on all charges of Aggravated Assault against an officer where the client was facing 5 7.5 years in prison, if convicted. Dismissal of all charges of Aggravated DUI after litigating a Motion to Dismiss for the officer’s failure to have reasonable suspicion to stop the client. This client faced a minimum sentence of supervised probation with four months in prison, if convicted. Dismissal of all charges of Misconduct Involving Weapons after litigating a Motion to Suppress evidence based on an unlawful search and seizure. Dismissal of all charges of DUI after litigating a Motion to Dismiss for a violation of the clients right to counsel. Dismissal of all charges of DUI after litigating a Motion to Dismiss based on a lack of reasonable suspicion to stop the client. Federal sentence of twelve months and one day on a complex Embezzlement case where the client was accused of stealing over $800,000 from her employer, a local credit union. The clients calculated offense level was a 20, with a recommendation in the Bureau of Prisons for between 33-41 months however, Ms. Whalin obtained a sentence of twelve months and a day, receiving early release on her sentence.Pre-Charge Cases Case closed with law enforcement/No charges filed Felony Sexual Assault; accusation of a date rape involving a local fraternity member in Flagstaff, Arizona. Successful at having case closed exceptionally. Case closed with law enforcement/No charges filed Felony Child Molestation; accusation of sexually molesting the six-year-old step-daughter. Successful at having case closed by law enforcement. Case closed with law enforcement/No charges filed Felony Sexual Assault and Kidnapping; allegation of sexual assault and kidnapping on an ex-spouse. Successful at having case deemed unfounded by law enforcement and no charges were filed. Case closed with law enforcement/No charges filed Felony Child Abuse; allegation of continuous abuse of infant daughter to include broken bones and healing fractures; Successful at having case closed by law enforcement and no charges filed. Case declined by Pinal County Attorney/No charges filed Felony Sexual Abuse; allegation of inappropriately touching the breast of a 12-year old family friend. Successful at having the case declined to be charged by the County Attorney’s office. Case declined by Pinal County Attorney/No charges filed Felony Public Sexual Indecency; accusation of 67-year-old male exposing and masturbating his penis to a 13-year-old girl. Successful at having County attorney decline to file charges. Case declined by Maricopa County Attorney/No charges filed Felony Embezzlement and Fraudulent Schemes; accusation of an embezzlement scheme of over $100,000. Successful at having County Attorney decline to file charges. |
