Description | Colleen is an experienced trial lawyer, focusing her practice on complex business, employment, commercial real estate, and tort litigation. Colleen’s most recent trial success came in August 2012 with a million-dollar victory in Norfolk Superior Court for a railroad corporation against a municipality for breach of a long-term waste hauling contract. Earlier in 2012, Colleen successfully negotiated a takeover of a $12 million line of business for a regional staffing company and avoided litigation involving a non-solicitation provision.In 2011, the First Circuit affirmed summary judgment in favor of Colleen’s employer-client in a case alleging violations of the Fair Labor Standards Act, the Massachusetts Overtime Act, the Massachusetts Wage Act, and the Rhode Island Payment of Wages Statute (which decision was spotlighted in the National Law Journal and Massachusetts Lawyers Weekly). Colleen is also proud to have been appointed as a Board member to the Massachusetts Children’s Trust Fund in 2011.In 2009, Colleen was honored by Women’s Business Boston Journal as one of the top 10 lawyers in Massachusetts, New Hampshire and Rhode Island for her top notch legal services and advice to corporate clients.Colleen has developed a specialty in the area of employment law and litigation, representing both employers and employees. Colleen regularly advises employers regarding personnel issues, statutory compliance, and discrimination matters, and negotiating and drafting employment documents such as employment, non-competition, non-solicitation, and severance agreements. Colleen recently prevailed in dismissing claims under the Older Workers Benefit Protection Act and Wage Act brought by a shareholder-physician against Colleen’s medical practice client; and Colleen argued successfully at the Massachusetts Commission Against Discrimination to affirm a lack of probable cause determination in a race discrimination case filed by an employee against a large human resources consulting firm.Colleen currently represents the MBTA regarding various employment-related matters. Colleen also has defended a number of Federal Employer Liability Act (FELA) cases for the MBTA and its contractor which operates the commuter rail system in Greater Boston, Massachusetts Bay Commuter Railroad Company, LLC (MBCR).Colleen’s extensive trial experience includes: a month-long jury trial in the Business Litigation Session against a brokerage firm for aiding and abetting the conversion of $8.6 million of escrow funds; a bench trial in the Business Litigation Session resulting in a ruling in favor of a commercial tenant against its landlord with national operations for breach of the implied covenant of good faith and fair dealing; a trial in the United States District Court for the District of Massachusetts involving a novel issue of law under ERISA related to deferred compensation plans; a two-week jury trial in Norfolk Superior Court resulting in a $6.4 million verdict for breach of a distribution agreement; a trial and G.L. c. 93A phase in Middlesex Superior Court awarding double damages and attorneys’ fees against a competitor for theft of confidential trade secrets; and, a construction dispute tried in Middlesex Superior Court, which was affirmed on appeal after argument by Colleen to the Supreme Judicial Court.In addition, Colleen has prevailed in arbitrations, including two separate matters in New York; in one, she obtained a $12.9 million award and, in the other, she successfully defended an alleged breach of a manufacturer’s sales representative agreement.Colleen is a 1992 graduate of the University of Vermont and graduated from Northeastern University School of Law in 1997. She also attended the Program for Women in Politics and Government at the University of Massachusetts after college.Colleen kicked off her legal career with a clerkship for the Massachusetts Superior Court and has spent the past fifteen years litigating in Massachusetts state and federal courts, including the First Circuit Court of Appeals, the United States District Court, the Supreme Judicial Court, the Massachusetts Appeals Court, and the Massachusetts Superior Court with several cases in the Business Litigation Session. Colleen also has filed and opposed petitions for certiorari to the United State Supreme Court.Colleen was named as one of Massachusetts Rising Star Super Lawyers in 2005 by Law & Politics and Boston Magazine.
