Description | Joseph D’Aversa has engaged in the general practice of law since becoming an attorney in 1995 specializing in Personal Injury, Workers’ Compensation, Criminal Law and Municipal Court Practice. Having spent the first five years of his legal profession as a municipal prosecutor, Joe gained invaluable insight into the New Jersey municipal court system which has served him well in representing those who have been issued traffic summonses from speeding to Driving While Intoxicated and disorderly persons offenses from marijuana possession to simple assault. Such prosecutorial experience lead to several appointments as special prosecutor for governmental disciplinary hearings. As a criminal defense attorney, Joe succeeded at the New Jersey Appellate Court level in overturning the denial of his client’s admission into the New Jersey Pre-Trial Intervention (PTI) Program and, thus, ensuring that all future applications in the County where said denial occurred are evaluated properly. Joe also obtained favorable results for those facing harsh criminal penalties. In the area of personal injury, Joe has recovered substantial damages for many of his clients. Of note are the following: Couls v. Ozah, VAS Transport, et al. (Superior Court, NJ), where Joe, acting as lead counsel, mediated a settlement of $225,000.00 for a client who underwent a two-level cervical fusion after being rear-ended by a tractor trailer; Baker v. Monaco, et al. (Superior Court, NJ), in which Joe negotiated a settlement in the amount of $175,000.00 for a teacher who had to undergo a cervical fusion after being rear-ended on her way to work; and DeFabrizio v. Harkins, Power Protection Services, et al (Superior Court, NJ) where Joe was able to recover $120,000.00 for a client who was broadsided at an intersection. Joe has had similar success with his Workers’ Compensation clients. Joe’s most notable cases include: Miller v. Pat’s Pizza (Workers’ Compensation Ct., NJ) where Joe obtained a lump sum payment for his client in the amount of $295,000.00 after the death of her husband; Patel v. Dunkin Donuts (Workers’ Compensation Ct., NJ) where Joe obtained a permanency award of $147,000.00 for his client was struck and dragged by a vehicle suffering multiple fractures requiring surgery and skin loss requiring grafting. Neidl v. Ace Property Management (Workers’ Compensation Ct., NJ) in which Joe was able to obtain temporary disability benefits for a client who fell twenty feet from a ladder and fractured his neck, back and both wrists. The court determined that an employer-employee relationship existed and, therefore, the client was entitled to such benefits. Joe earned his J.D. from Widener University Law School (now Widener Law Commonwealth) where he honor grades in property and professional responsibility. Joe was born and raised in South Jersey and, other than his brief stints at Rutgers University, New Brunswick, NJ and Widener University Law School in Harrisburg, PA, has maintained his residence here. Joe makes staying in shape a priority if for no other reason than to keep up with his 6 year old, Nina, and 4 year old, Ava. Joe’s lovely wife, Dyan, is a hairstylist in South Jersey.
