Since becoming licensed to practice law in the State of Florida in 2013, Merriman has primarily focused in the practice areas of probate administration, trust administration, estate planning, guardianships, probate litigation, trust litigation, and guardianship litigation. Merriman has assisted clients in estate and tax planning, with the goal of formulating estate plans that maximize the clients’ desires with regard to the disposition of their property, while minimizing adverse tax consequences. He has assisted clients in the settling of estates by representing them in formal, summary, and ancillary probate administrations. He has also helped clients in the administration and settlement of trusts. Merriman has experience litigating issues related to trusts and estates, as well as guardianships. Merriman has prosecuted and defended lawsuits involving the contesting of wills, codicils to wills, trust instruments, and beneficiary designation forms, in which a party seeks to invalidate a testamentary instruments and typically include allegations of undue influence, incapacity, fraud, duress, coercion, or lack of proper execution. Merriman has experience litigating issues related to the termination and modification of trusts, as well as actions involving the construction of wills and trust instruments. He has litigated issues involving breaches of fiduciary duty or breaches of trust by a personal representative of an estate, a trustee of a trust, an agent under a durable power of attorney, and a court-appointed guardian in a guardianship matter. He also has experience litigating guardianship issues involving the incapacity of an alleged incapacitated person and the appointment of a guardian for an incapacitated person. Involvement & Education Merriman earned his Juris Doctor from the University of Miami School of Law in 2013, graduating magna cum laude and being named to the University of Miami chapter of the Order of the Coif. He earned his Master of Laws (LL.M.) in Taxation from New York University School of Law in 2018. In 2019, he was bestowed the title of Board Certified Specialist by the Florida Bar by earning Florida Bar Board Certification in Wills, Trusts & Estates. Merriman completed his undergraduate degree at the University of Louisville, double majoring in Philosophy and Humanities, while obtaining a minor in Religious Studies, and was the recipient of the Richard Campbell Smith Memorial Award for Excellence in Philosophy in 2009. While at the University of Louisville, he was elected and served as the President of the Sigma Chi Sigma chapter of the Delta Upsilon Fraternity. In 2009, Merriman was also commissioned as a Kentucky Colonel by Governor Steve Beshear, thereby earning the highest title of honor bestowed by the Commonwealth of Kentucky. Merriman and his wife, Corinne, have two children, Corey and Hailey. He is actively involved in the Estate Planning Council of Lee County, the Southwest Florida Guardianship Chapter of the Florida State Guardianship Association, and the Real Property, Probate, and Trust Law Section of the Lee County Bar Association. Merriman is an avid reader of classics and enthusiast of bourbon who enjoys playing tennis and basketball, watching sports, playing guitar, and listening to records. |
