Mr. Byrd and fellow associates Kelsi White and Justin Rowinsky took over this thirteen-year-old case on the eve of trial and defeated a big-law team consisting of four partners and multiple associates.As lead counsel, obtained a unanimous jury verdict in the Southern District of Texas that will result in the recovery of more than $1 million of collateral for secured creditors A.M.Y. Property & Casualty Insurance Corporation and FinServ Casualty Corporation against unsecured creditors Symetra Life Insurance Company and Symetra Assigned Benefits Service Company. This trial required proving priority to certain asset-backed securities under a relatively uncommon section of Article 9 of the Uniform Commercial Code and required defeating fraudulent-transfer and alter-ego defenses that attacked business models involving asset-backed securities and captive insurance.As lead counsel, obtained summary judgment in the Southern District of Texas to recover approximately $800,000 in collateral on behalf of secured creditors A.M.Y. Property & Casualty Insurance Corporation and Finserv Casualty Corporation against unsecured creditors Symetra Life Insurance Company and Symetra Assigned Benefits Service Company. This case required establishing priority under Article 9 of the Uniform Commercial Code and defeating fraudulent-transfer and alter-ego defenses that attacked business models involving captive insurance.As lead counsel, obtained dismissal in state court of negligence and negligent-supervision claims involving personal injuries allegedly in excess of $1 million on behalf of Genuine Parts Company.As lead counsel, successfully prosecuted claims involving covenants not to compete and misappropriation of trade secrets. On the plaintiffs’ side, Mr. Byrd’s clients have secured temporary restraining orders, recovered substantial attorney’s fees, and obtained settlements from defendants involving multi-year and multi-state restrictive covenants. On the defendants’ side, Mr. Byrd has helped clients obtain the prompt dismissal of frivolous non-compete and trade-secret claims designed to unfairly limit clients’ business activities.As second chair, obtained a favorable settlement involving attorney’s fees and multi-year restrictive covenants following a two-day temporary-injunction hearing in state court on behalf of a global oilfield-services company against two former executives who breached restrictive covenants and misappropriated trade secrets in an effort to jump start a competitor to Mr. Byrd’s client.As second chair, obtained a favorable settlement following jury selection in state court on behalf of an enterprise-software company against a large health-insurance company in a case involving contract and declaratory-judgment claims in excess of $2 million. |
