Description | Kevin is a member of the Professional Liability Department where he focuses his practice on environmental and toxic tort matters. In this role, he handles a wide array of cases including Superfund claims, cost recovery and contribution actions, and private-party litigation involving multi-plaintiff property and personal injury claims.A trial attorney for more than 10 years, Kevin has litigated hundreds of cases in both state and federal court, including cases before the New Jersey Appellate Division and the New Jersey Supreme Court. He has experience with a wide-range of environmental and toxic tort matters including, claims for soil and groundwater contamination, resulting from contaminants such as mercury, trichloroethylene (TCE), benzene, polychlorinated biphenyls (PCBs), perchlorate, pesticides, gasoline and home heating oil. As it relates to toxic torts, Kevin has experience handling claims for mold-exposure, radon gas, lead, fecal contamination and asbestos. Kevin also handles environmental and toxic tort coverage cases, which involve complex allocation issues among various carriers pursuant to the New Jersey Supreme Court’s decision Carter-Wallace, Inc. v.Admiral Ins. Co., 154 N.J. 312 (1998).Kevin graduated from Widener University in Chester, Pennsylvania in 2003, where he obtained is B.A. He attended Widener University School of Law in Wilmington, Delaware, where he earned his juris doctor in 2006. Kevin graduated magna cum laude and in the top five percent of his law school class. During his tenure at Widener, Kevin was a member of both the Moe Levine Trial Advocacy Honor Society and the Moot Court Honor Society, where he achieved national recognition by finishing first place in the Rendigs National Products Liability Moot Court Competition in Cincinnati, Ohio.Kevin’s academic excellence in law school earned him distinction by receiving one of only three appointments awarded to the Order of the Barristers National Honor Society for Excellence in Courtroom Advocacy. Kevin was also a recipient of the Law Grant Scholarship for academic excellence.After graduation, Kevin spent four years practicing with a small law firm in Woodbury, New Jersey. Environmental & Toxic Tort LitigationAugust 24, 2020 The plaintiff filed an Order to Show Cause to compel the defendants to defend and indemnify it in connection with a leak that occurred at a retail gasoline service center. A company retained to perform recent soil and groundwater sampling at the site punctured a 10,000 gallon underground storage tank. The plaintiff did not have the funding to perform the investigation or remediation of the property and, therefore, filed the Order to Show Cause. Successful Defense of Environmental Subrogation Case Involving Leaking Underground Storage Tank. Environmental & Toxic Tort LitigationAugust 24, 2018 The defense prevailed on a motion for summary judgment as to liability in an environmental case involving claims related to a leaking underground storage tank (UST). Our client sued a fuel delivery company under the New Jersey Spill Compensation and Control Act for delivering fuel oil to the UST while the UST was leaking. Our client also asserted claims for negligence and breach of contract. The defendant also moved for summary judgment, seeking to dismiss our client’s claims on the basis of a disclaimer printed on the delivery tickets, which were subsequently mailed to the insured. The defense represented an environmental testing company hired by the company that performed a remediation in the plaintiffs’ home following a sewage backup in 2007 that resulted in several inches of raw sewage backing up in the plaintiffs’ basement.
